CHARTER FOR ****** SCHOOL
WHEREAS, the ******** School, to be located in the ****** County School District (hereinafter "Petitioner") has petitioned the Georgia Board of Education (hereinafter "State Board") for status as a Charter School, said petition being attached hereto as Exhibit A and incorporated herein by reference;
WHEREAS, said completed petition has been approved by the ****** County Board of Education (hereinafter "Local Board");
Whereas, Petitioner, Local Board and State Board agree that all duties and operation of ******** School will be performed pursuant to the terms and conditions detailed in the charter petition attached as Exhibit A.
WHEREAS, the State Board has determined that the petition meets the requirements set forth in the Charter Schools Act of 1998 §
O.C.G.A. 20-2-2060 et.al. and is in the public interest.
NOW THEREFORE, pursuant to O.C.G.A. §
20-2-2064, the State Board grants this charter to Petitioner for a period of *** years, to expire on **********, to permit Petitioner to operate in accordance with the terms of this Charter. Modification and termination of the charter shall be in accordance with §
O.C.G.A. 20-2-2060 et.al.
ASSURANCES. Petitioner assures that the school will operate in accordance with the United States Constitution, the Constitution of the State of Georgia and federal and state law, except for the exemptions granted by this charter. Petitioner also assures that it will operate fairly and equitably for all students and with consideration of the needs of the diverse student population. Petitioner assures that it will operate with full public disclosure about student performance and in accordance with state and federal confidentiality laws.
SEVERABILITY. If any provision of the charter is determined to be unenforceable or invalid for any reason, the remainder of the Charter shall remain in effect, unless otherwise terminated by one or all parties in accordance with the terms contained herein.
This charter shall be interpreted in accordance with O.C.G.A. §
20-2-2060, et. al.
