| Legislative Summary | Passed in 1995, New Hampshire's charter law set a cap, expiring in 2000, of 10 schools per year. Local districts may limit the number of students who may enroll in charter schools in their district. Public schools, non-profit organizations, and parent/teacher groups are eligible charter school operators. Local boards must first approve charter applications, which are then sent to the State Board for authorization. Charter terms are 5 years, renewable for 7 years. For conversion public schools, basic operational funding is generally comparable with other public schools. However, new start up charters receive a minimum of 80% of public school funding at the discretion of the State Department of Education. New Hampshire charter schools are automatically waived of most state education laws and can be legally independent entities. Charter schools are required to participate in the NH statewide education improvement and assessment program.
