Brief OverviewIn 1993, Georgia first adopted a charter school law. Legislative revisions have been made during the 2002 session to include changes such as an amendment to clarify that the initial term of a charter must be a minimum of 3 years but must not exceed 5 years. As of December of 2002, there are 35 charter schools in operation serving over 15,100 students. Six others have been approved to open in the fall of 2003.

Legislative SummaryLegislation authorizing the Georgia Charter Schools Program was enacted by the Georgia General Assembly in 1993 and changed again in 1998 with the passage of the Charter Schools Act. Additional amendments have been made in 2002. The State Board of Education is authorized to grant an unlimited number of charters for 5-year terms, with funding comparable to other public schools. Their contract exempts them from most state and local rules, regulations, policies, and procedures and from provisions of Title 20 of Georgia law except for the Charter Schools Act of 1998.
