| Legislative Summary | Enacted in 1996, New Jersey's charter school law calls for a statewide cap (expiring January, 2000) of 135 schools. Charter approval authority comes from the State Commissioner of Education after passing through the local boards or state superintendent in state-operated school districts. Teachers and parents of public school children, institutes of higher education, and private organizations collaborating with parents and teachers are eligible charter school operators in New Jersey. Charter terms are 4 years, renewable for 5 years. Waivers from state education laws and regulations are permitted upon request only. Operational funding is usually negotiated and is not necessarily comparable with other schools in the state. NJ charters must use existing public school standards as a "floor" and must administer existing public school assessments.
