| Brief Overview | Ohio's charter school law was originally passed in 1997 allowing conversion charter schools, also known as "community schools," in all school districts, but limiting start-up schools to the Big Eight urban districts whose student populations were over 12,000. In 1999, the charter school legislation expanded the definition of a community school to include start-up schools in the Urban 21 school districts. In 2000, the law was expanded to allow community schools to be established in any school district designated as an academic emergency district by the Ohio Department of Education. There are currently 131 community schools in operation, which includes 3 digital community schools. 52 of the community schools are sponsored by the State Board of Education. |

| Legislative Summary | Passed in 1997, Ohio's charter school (Section 3-132 of Title 70) law places no cap on the number of charter schools that can be created. The State Board of Education authorizes charter schools. Charter schools are exempt from most state education laws and regulations and operate under a maximum term of five years. Funding for these schools is limited to the state foundation amount per student and does not include funds from local property taxes. Charter schools must employ teachers properly certifed by the Ohio Department of Education and must take part in the state's proficiency testing program.
