Charter school legislation was passed in Virginia in 1998, but eight years later only three charters are in operation. "The arrangement with school boards holds back charter schools," said Don Soifer of the Lexington Institute, a pro-charter school think tank in Arlington. Local boards are the sole authority, no appeals are possible, and charters receive few waivers on operating requirements. Del. Scott Lingamfelter decries state law that he said stymies charter school creation in Virginia. Charter schools "work, and they don't cost as much and there is more innovation," he said. According to Soifer, the Virginia Education Association (VEA) and the Virginia School Boards Association have lobbied successfully for heavy restrictions on charter schools. "If it ain't broke, don't fix it," said Sen. H. Russell Potts Jr., the chairman of the state Senate's Education Committee who has been an ally of the VEA and opponent of charters.
