In a friend-of-the-court brief filed April 17 in U.S. District Court in Columbus, several Democrat legislators claimed that Ohio is "moving backward" on school funding by funding charter schools, as well as depending on local school tax issues. They are attempting to revive a 1991 federal lawsuit that asserted Ohio was violating the state constitution and federal disability laws by failing to provide a "thorough and efficient" education for disabled children. That lawsuit was shelved in favor of an action filed in state court by low-wealth school districts that challenged the funding system on behalf of all students. State officials are seeking dismissal of the federal lawsuit. Gov. Bob Taft and Republican legislative leaders have also pointed out that during Taft's tenure, education funding has increased 33 percent. A ruling on the dismissal motion is expected soon.
