Virginia's charter school legislation is one of the nation's most restrictive. Local boards are the sole authority, no appeals are possible, and charters receive few waivers on operating requirements. The state has only three charter schools and national charter school organizations, such as KIPP, have not been encouraged to come to the state. Former Governor Mark Warner said he considered asking the legislature this year to make it easier for KIPP to come to Virginia, but he didn't pitch legislation because he was leaving office. "Virginia does not have a great charter school law in terms of providing freedom for the schools," said KIPP founder Michael Feinberg. "We would have to find a reform-minded school district that would give us the power to run the school with our program."
