On January 5, the Florida Supreme Court ruled 5-2 that the state's voucher program violated the state constitution's uniformity clause, which calls for a "uniform, efficient, safe, secure, and high quality system of free public schools." The decision has buoyed the hopes of charter school opponents in Ohio who have challenged charter schools in a lawsuit now before the Ohio Supreme Court. The arguments against Florida's vouchers and Ohio's charter schools are similar. Choice opponents in both states have argued that the state constitutions require one equal system of education statewide and that the choice options have created dual, unequal systems. The Florida voucher case "is a victory for taxpayers and public schools," said Lisa Zellner of the Ohio Federation of Teachers, one of the groups suing the state over charter schools. "There should not be a separate system. That is part of the basis of the Supreme Court case here."
