No, charters are indeed subject to AYP. But in the Department's guidance on the impact of Title I (NCLB) on charter schools (available at http://www.ed.gov/policy/elsec/guid/edpicks.jhtml?src=ln), Paragraph A-3 says that AYP does not need to be inserted into the charter contract itself. This gives authorizers the ability to implement appropriate consequences -- but also gives them some leeway in determining the effect of AYP on charter renewal. I'm working with three authorizers now, for example, that all consider AYP as an important factor but make judgmements about renewal on a wider range of information including value-added measures, comparisons of test performance with comparable schools, and information about the school's organizational and financial viability.
